Like we see restaurants everywhere put up a board “We have no branches anywhere”, car manufacturers will probably have to issue a similar declaration for their products. Tata Motors is the aggrieved party this time. Tata Motors has filed a complaint before a Delhi Court alleging infringement of its trademark and copyright by unknown persons manufacturing and marketing spurious ancillary automobile products under its name.
Tata Motors told the court that it manufactures and sells automobiles along with other ancillary products. Since the company has a reputation to live upto such counterfeit and spurious activity will do a lot of damage.
"The company stands to suffer serious losses and prejudice if any person illegally violates and misuses the trademark and copyright of the company to market its own counterfeit and spurious products of sub-standard quality," the complaint said.
It said the unknown persons are the applying name of the company to their inferior products and have in their possession dies, blocks, plates, instruments, devices and machinery for falsifying the trademark of TATA Motors.
It also said the general public is being cheated into buying counterfeit products from the accused who make them believe that it is product of TATA and wrongful loss is being caused to the company.
This complaint has been filed in the interest of maintaining the company’s brand image. Although this case will not stop counterfeiters it will serve as a warning not to target the brand.
EDIT: Tata Motors has cautioned potential customers and the general public on fraudulent promotional offers and advertisements wherein amongst other things, the person or group of persons have been wrongfully extracting/ demanding cash deposit(s) in certain specified bank(s) from general public. These individuals are also wrongfully using Tata Motor’s registered trademark to lure public into this trap.
Tata Motors would like to state that these communications are purely made with the intent to defraud the general public and Tata Motors has not authorised any person to require any payment /cash deposit to be made.
The company advised that individuals exercise caution and not fall prey to any such fraudulent promotional offers purported/claimed to be sent on behalf of Tata Motors.
